These Terms & Conditions relate to promotions offered by The Brogue Trader Limited to win a specified prize(s) by entering a competition or promotion through our website, social media, email sign-up or via other methods that interact with our website at https://www.thebroguetrader.com.

These Terms & Conditions prevail in the event of any conflict or inconsistency with any other communications including advertising or promotional materials. Entry and claim instructions are deemed to form part of the Terms & Conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the Terms & Conditions. The Brogue Trader Limited takes data protection seriously. By entering in this promotion, you confirm that you have read the Privacy Policy and agree to these Terms & Conditions of the promotion. Eligibility & Promotional Period

1. This promotion is open to Mainland UK (England, Scotland and Wales) residents aged 18+ only, excluding employees and their immediate families of The Brogue Trader Limited, its affiliated companies, distributors, agents and anyone professionally associated with this promotion.
2. Purchase necessary. Participants will automatically be entered into the promotion when ordering a full price pair of shoes from The Brogue Trader website at https://www.thebroguetrader.com between 00:00:00 on Monday 2^nd October 2023 and 23:59:59 on Sunday 5^th November 2023.
3. Internet access required. Full payment must be made at the time of qualification through credit or debit card or Klarna split payments.
4. All qualifying purchases made between 00:00:00 on Monday 2^nd October 2023 and 23:59:59 on Sunday 5^th November 2023 will be entered into the promotion. Maximum of one (1) prize per person.
5. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of programme, application, script, brute force or any other automated means, that person’s entries will be disqualified, and any prize(s) awarded will be void.
6. Where Return Requests are received for qualifying purchases before 23:59:59 on Sunday 5^th November 2023, the corresponding Order Number will be deemed void and ineligible for entry into this promotion.
7. Anyone trying to circumvent the rules states in these Terms & Conditions by using alternative details will be disqualified from this promotion.

Entry Requirements

8. For your chance of winning, purchase a full price pair of shoes from The Brogue Trader website located at https://www.thebroguetrader.com. Purchase from other websites, including marketplaces, supplier or manufacturer websites will NOT be eligible for entry.
9. Website orders received before 00:00:00 on Monday 2^nd October and after 23:59:59 on Sunday 5^th November will not be eligible for participation and will not be included within the prize draw.
10. Incomplete, illegible, misdirected or orders received outside of the promotional period will not be accepted. The Brogue Trader Limited takes no responsibility for entries/orders delayed, incomplete or unpaid due to technical reasons or otherwise.
11. This promotion is available on all full priced pairs of shoes available on The Brogue Trader Limited website, found at https://www.thebroguetrader.com.

Prize Details

12. 10x £250.00 GBP Online Gift Vouchers redeemable on The Brogue Trader website located at https://www.thebroguetrader.com.
13. The prize(s) will be credited to the Online Account used for the winning Order Number(s) and can be used against any, and all items, available on The Brogue Trader website at the time of purchase.
14. The prize(s) are as stated, are not transferable and cannot be exchanged for cash or other alternatives. The Brogue Trader Limited reserves the right to substitute a prize for an alternative of equal or greater value.
15. The winner(s) will have twelve (12) months from the date the Online Gift Voucher is credited to their account to redeem in full. If the Online Gift Voucher is not used or remains part-used after twelve (12) months, the remaining prize value will be null and void.
16. Should the value of any purchase(s) on The Brogue Trader website where the Online Gift Voucher is redeemed, exceed the value of £250.00 GBP, the winner will be obliged to contribute the remaining balance at the time of purchase using an available online payment method.

General

17. The Brogue Trader Limited’s decision is final regarding all promotional matters.
18. All entrants will be required to provide a genuine email address that is personal, valid, and accessible as part of the original ordering process. In the event of an email address becoming inaccessible during the promotion, The Brogue Trader Limited is not able to retrieve and amend any existing entries/orders to a new email address.
19. Limitations of liability: Neither The Brogue Trader Limited, its agents or anyone professionally connected to the promotion, assume any responsibility or liability for:
    1. Any unauthorised access to, or theft, destruction, or alteration of orders at any point in the operation of this promotion. Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilised in any aspect of this promotion;
    2. Inaccessibility or unavailability of the internet, website, microsite, or any combination thereof;

The Brogue Trader Limited reserves the right at its sole discretion to disqualify any participant found to be tampering with the entry process, eCommerce operations or the operation of the promotion; or to be acting in any manner deemed by The Brogue Trader to be in violation of the Terms & Conditions; or to be acting in any manner deemed by The Brogue Trader Limited to be disruptive.
21. If for any reason, any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical administration, security, fairness, integrity or proper conduct of this promotion, The Brogue Trader Limited may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event, or circumstance occurs which is beyond the reasonable control of The Brogue Trader Limited and which prevents The Brogue Trader Limited from complying with these Terms & Conditions, The Brogue Trader will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants to avoid undue disappointment.
22. Subject to The Brogue Trader Privacy Policy, winners names will be announced and made available for a period of no more than fourteen (14) days following the end of the main promotion period.
23. The Brogue Trader Limited and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
24. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms & Conditions and the remaining clauses shall survive and remain in full force and effect.
25. The promotion and these Terms & Conditions will be governed by the laws of England, Scotland and Wales but any disputes as to the meaning of these terms will be subject to the exclusive jurisdiction of the participant’s local courts.

The Brogue Trader will only use the personal details supplied for the administration of the promotion and the auditing of the entries where necessary and for no other purpose, unless we have your consent/you have opted-in to receive future marketing communications. The Surnames and Counties of Verified Winners will be made available as set out in Clause 22 above and winners can object to this by emailing website@thebroguetrader.com. Otherwise, your personal details will at all times be kept confidential and in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018 as applicable. 27. You can request access to your personal data, have any inaccuracies rectified or request deletion of personal data by sending an email to website@thebroguetrader.com. By participating in the promotion, you agree to the use of your personal data as described here. You can withdraw your consent at any time. For the purpose of this promotion, requests to delete personal data can only be actioned after the promotion has concluded and are restricting to reasonable data in association with customer orders.
